A Melfort woman who was sentenced to three years in prison for conspiracy to commit murder is appealing her conviction.

Angela Nicholson is asking to be granted bail based on the trial judge's words to the jury.

Nicholson's lawyer says that the judge didn't stress that the jury had to find beyond reasonable doubt that Nicholson intended to put the agreement to commit murder into action.

The co-accused, Wakaw's Curtis Vey, is expected to appeal as well, but has yet to do so.

Nicholson and Vey were sentenced on September 2 in Prince Albert.
